Introduction

1.1. The sales of products performed remotely through the website http://www.effeluxuryvintage.com (hereinafter referred to as the “Website”) are subject to the following General Conditions of Sale.
The products offered on the Website are sold directly by EFFE FASHION GROUP SRL, a company established under Italian law with registered office at Via Giuseppe Candiani 101 – 20158 Milan (MI) – Italy, VAT number 11804420963, registered with the Milan Companies Registry.

1.2. The distance selling services provided for in these General Conditions of Sale are intended exclusively for consumers (hereinafter referred to as “Customers” or in the plural “Customers”), who are natural persons aged 18 years or older (or in the case of minors, authorized by their legal representatives) acting for purposes unrelated to their commercial, entrepreneurial, artisan or professional activity.
The resale or transfer of products purchased on the Website for any commercial or professional purpose is expressly prohibited.

1.3. The products sold on the Website can be shipped worldwide, unless restrictions are imposed and/or advised by the shipper.

1.4. The languages used for the conclusion of the sales contract through the Website are: Italian and English.

1.5. These General Conditions of Sale are published on the Website so that the Customer can know, store and copy them in accordance with the current legal regulations.

1.6. The purchase of the Products is subject exclusively to the General Conditions of Sale published on the Website and valid at the time of purchase. The Website reserves the right to change and/or supplement these General Conditions of Sale at any time. Any changes and/or supplements will only be valid for purchases made after the date of publication of the new version of the General Conditions of Sale. Replacing these General Conditions of Sale with a new version means that they are automatically inapplicable, invalid and unenforceable for purchases made after their removal from the Website, even if the said General Conditions of Sale are in any case available for consultation and/or access by the public through other websites other than the said Website.


Product Availability

2.1. The Customer acknowledges that the products offered on the effe luxury vintage Website (hereinafter referred to as the “Products”) are limited in quantity and therefore understands that the Company must verify their availability at the time of purchase.

The availability of certain Products may occasionally be inconvenient. In this case, effe luxury vintage will promptly (and in any case within the period specified below) inform the Customer of the cancellation of the order by e-mail.
If only some of the Products are available, the Customer will be notified and can decide within seven days whether to cancel the entire order or to receive only the available Products.
effe luxury vintage reserves the right to change the items offered for sale on the Website at any time and without prior notice.
Purchase procedure
3.1. Each Product offered for sale on the Website can be viewed through a specific link that allows you to see the product’s photo, unit price, color and different sizes (if any).

3.2. The Customer may purchase one or more Products, effe luxury vintage reserves the right to change the quantity limits of the Products that can be purchased through the Website at any time.

3.3. The Products selected by the Customer will be placed in a specific section (hereinafter referred to as the “Shopping Cart”).
The description of the Product, including the dimensions (if any), as well as one or more photographs in digital format in order to correctly present the Product, will be included in the Customer’s Shopping Cart.

3.4. Although effe luxury vintage constantly takes steps to ensure that the photographs displayed on the Website faithfully reproduce the original Product, some differences may always occur due to the technical characteristics and color resolution of the equipment used by the Customer. Therefore, effe luxury vintage is not responsible for any defects in the graphic representation of the Products displayed on the Website due to the aforementioned technical reasons.

3.5. To view the selected Products and the total price of the purchase order, you need to access the shopping cart page.
Before confirming the order proposal (hereinafter referred to as the “Order Proposal”), the Customer is required to verify the accuracy of the contents of the Shopping Cart and to fill in the purchase form according to the instructions provided on the Website.

3.6. The purchase process ends when the Customer selects the corresponding final order confirmation button (hereinafter referred to as the “Buy Button”), thereby confirming his Order Proposal, which will be sent directly to effe luxury vintage.
After selecting the Buy Button, the Customer will no longer be able to modify the contents of the Order Proposal.

3.7 Before confirming the Order Proposal, the Customer must declare that he has read and accepted these General Terms and Conditions of Sale. At the end of the purchase procedure, the Customer should save or print out these General Terms and Conditions of Sale.

3.8. The purchase procedure must be completed in full; otherwise, the Order Proposal cannot be sent to effe luxury vintage.

3.9. Each Order Proposal and the Customer data required for the purchase will be archived by effe luxury vintage for a period of time and in compliance with the conditions stipulated by the current legislation. Any use of the data for purposes other than the purchase is subject to the prior express consent of the Customer and to the conditions set out in the Privacy Policy published on the Website.

3.10. Customers who have registered in the reserved area of the Website can check the status of their order by accessing that area and entering the page related to their order.

3.11. The Customer is aware that he is responsible for the correctness and authenticity of all the data entered on the Website or used during the purchase phase.

3.12 The Customer is also aware that on the Website he also has the following possibilities:

a) Order the products that you wish to permanently customize by adding permanent modifications in accordance with the methods indicated on the Website (for example, by hot stamping).

b) When purchasing a second-hand product, the Customer acknowledges in this case that by sending the purchase order, the User declares that he is aware that he is purchasing a second-hand product. Therefore, the defects covered by the guarantee that legitimize a return request are only those that are different from normal wear and tear of the product or do not arise from normal use (taking into account the previous time of use). The Buyer declares to have been informed that, given the nature of the product, the purchased item is unique and cannot be replaced by an identical item. Therefore, if the Buyer chooses the remedy of replacing a Product, he will only be able to choose a Product different from the one purchased, which meets his preferences and has a similar economic value to the Product identified as non-compliant by effe luxury vintage.
The Customer acknowledges that, at the time of sending the Order Proposal, these Products were not yet available for shipment. Products that can be reserved by the Customer are clearly identified and indicated on the Website by the expression “Reservation” or “Reservation Product” and Products that can be customized by the Customer are clearly identified and indicated on the Website by the expression “Customized Product”.

3.13 The Customer acknowledges and accepts that if the Customer reserves a Product and/or orders a Personalized Product, the relevant price displayed on the Website and in the Shopping Cart section will be charged to the Customer in advance, i.e. upon receipt of the confirmation email, as defined in point 4.2 below, even though the Reserved Products and Personalized Products are not ready for shipment at that time. The Reserved Products and Personalized Products
will be delivered to the Customer by the estimated relevant date specified on the Product description page.
If the order proposal sent by the Customer contains one or more Pre-Order Products and/or Customized Products in addition to already available Products, the prices of all Products related to this order proposal will be charged to the Customer in advance, i.e. upon receipt of the confirmation email, even if the Pre-Order Products and Personalized Products will be delivered before the last estimated relevant delivery date indicated in the Product description page.

3.14. All further details on payment, delivery and confirmation of Pre-Order Products and Personalized Products are specified in the corresponding sections below.

3.15. The Customer acknowledges and accepts that, except as expressly provided for in this context in relation to Pre-Order Products and Personalized Products, the other provisions of these General Terms and Conditions of Sale also apply to Pre-Order Products and Personalized Products.


Conclusion of the contract

4.1. Once the order proposal has been confirmed, it will be sent to effe luxury vintage for processing and cannot be further modified.
The order proposal sent by the customer will only be accepted by effe luxury vintage if the entire purchase process has been completed normally and there is no evidence of any error on the website. After placing the order proposal, the customer will receive an email by which effe luxury vintage will inform the customer of the receipt of the order proposal. This email cannot be understood as acceptance of the order proposal. The acceptance of the order proposal by effe luxury vintage and the conclusion of the contract will be carried out in accordance with the provisions of point 4.2 below.

4.2. The contract between effe luxury vintage and the customer is deemed to have been concluded when the customer receives one or more confirmation emails from effe luxury vintage (hereinafter referred to as the “Confirmation Email”).
The Confirmation Email will be sent to the address specified by the customer in the purchase form and contains a confirmation and summary of the purchase conditions themselves, such as: description of the product and its main characteristics, the total price of the order (including any shipping costs), information on the after-sales assistance service, the existence of a right of return and how to exercise it.

4.3. effe luxury vintage reserves the right not to accept an order proposal sent by the client in the following cases:

a) the products included in the order proposal are out of stock, despite the applicability to pre-order products;

b) there is a legal dispute between effe luxury vintage and the client related to a previous order;

c) if the client has previously violated the general terms of sale or failed to fulfil its obligations;

d) if the client purchased the products with the intention of resale or transfer for commercial or professional purposes;

e) if the client is involved in or suspected of illegal or fraudulent activities.

In the above cases, effe luxury vintage will inform the client by email of the cancellation of the order received within 30 (thirty) days from the date of actual receipt of the order proposal. In this case, effe luxury vintage shall not be deemed to have accepted any order proposal and no contract shall be deemed to have been concluded between effe luxury vintage and the client.

4.4 If the ordered products are partially available, if the client has chosen the option to receive the entire order, he will be asked whether he wishes to receive the available products or cancel the order completely. In case of only partial cancellation, the client will only pay the amount related to the products actually purchased.

Unless you have chosen the option to receive the entire order on the website, the client agrees to receive only the available products.


Prices and payment methods

5.1. The prices of all products sold on the Website are inclusive of VAT.

5.2. For products delivered in Italy, the prices will be indicated in Euros (EUR) and for foreign countries in any other currency.

5.3. The total price shown in the shopping cart includes any shipping costs, which will be indicated separately.
In any case, effe luxury vintage will ask the customer to expressly agree to any additional additional costs.

5.4. Once the customer has confirmed the order proposal by selecting the purchase button, the customer will be charged at the prices published on the Website and shown in the shopping cart, provided that the ordered products are available at that time, with the exception of order proposals containing pre-order products and/or customized products, the relevant prices of which will be charged to the customer in advance as provided for in point 5.6 below, even if such products are not ready for shipment at that time. effe luxury vintage reserves the right to change the prices of the products sold on the Website at any time and without prior notice.

5.5. effe luxury vintage accepts only credit cards and other payment methods expressly indicated on the Website.

For credit card payments, the Customer confirms and guarantees that he is the owner of the credit card used for the purchase and that all relevant data entered during the purchase phase are correct, such as: card number, expiration date and, if necessary, security code.

The Customer will be charged for the transaction only after:
(i) verification of the credit card details, (ii) receipt of payment authorization from the company that issued the credit card used by the Customer, and (iii) confirmation that effe luxury vintage’s products are available and once the order is ready for processing.

The entire transaction concerns orders containing only pre-ordered products or personalized products that are not ready for shipment at the time of the confirmation email, as well as orders containing pre-ordered products and/or personalized products, which will be charged for all products (including those already available) after receipt of the confirmation email.
Therefore, no fees will be charged when sending the order proposal.

5.7. For payments made through other payment service providers, the Customer confirms and guarantees that he is the owner of the account used for the purchase.
The Customer will be charged for the transaction only after he has received the confirmation email from effe luxury vintage.

5.8. The purchased products will be shipped only after the Customer has successfully paid the amount due.
If, for any reason, the Customer is unable to collect the amount due, the sales process will be automatically cancelled and the sale will be canceled, depending on the information sent to the Customer.

5.9. If one or more Products are out of stock and the Customer decides not to cancel the order in full, only the price associated with the available Products and any shipping costs will be charged.


Delivery

6.1. The Customer will receive the Products once they are ready for shipment. The Products will be shipped to the address indicated by the Customer in the Order Proposal. The Customer’s signature will be required upon delivery of the Products.

6.2. For security reasons, effe luxury vintage will not process any orders sent to a PO Box and will not accept any orders for which it is not possible to identify the natural person to whom the order will be sent and their address.

6.3. The Products sold on the Website can only be delivered to the countries listed above (Article 1.3). Therefore, any order proposal requiring delivery outside of the above countries will be automatically rejected during the order processing.

6.4. If the Customer is required to pay for shipping costs, these will be clearly stated separately from any other costs or expenses at the end of the procedure for completing the Order Proposal and before the Customer selects the purchase button.

6.5. The maximum period within which effe luxury vintage must deliver the purchased Products, in accordance with current legislation, is 30 (thirty) days from the date of conclusion of the contract, except in the case of force majeure.
If the order in question is for pre-ordered and/or personalised products, the delivery date will exceed 30 days and effe luxury vintage will deliver such products on the estimated delivery date or within the estimated delivery period agreed with the customer, as indicated to the customer on the product description page.

6.6. If effe luxury vintage does not deliver the ordered product within the aforementioned period, the customer must request effe luxury vintage to deliver it within an additional period that is appropriate in the case and in accordance with the legislation in force.
If the ordered product is not delivered within the specified additional period, this does not affect the customer’s right to terminate the contract immediately.

6.7. effe luxury vintage is entitled to divide the order into several shipments, depending on the availability of the products, and the customer will receive the products separately according to the availability of the products, unless the customer has selected the option on the website to receive the entire order at once. effe luxury vintage may charge the customer separately for only the products actually shipped or for a single solution.

6.8. Once the purchased product has been shipped, the customer will receive an email to the address specified in the order proposal. This email will contain a shipment tracking code and a unique link to track the shipment in real time. effe luxury vintage customer service will provide assistance for any issues related to the shipment. The Client may contact effe luxury vintage customer service by email at customercare@effeluxuryvintage.com

6.9. In addition to express delivery, the Client may also request, at the purchase stage, to collect the purchased Products directly from the store chosen on the Website, provided that the order in question does not contain pre-ordered products and/or personalized products. If the Client does not collect the Products within 15 (fifteen) days of receiving the email indicating that the Products are ready for collection, effe luxury vintage may cancel the sale. In this case, the Client will be notified of the cancellation by email and will be refunded 80% of the amount paid.

6.10. The Client assumes the risk of loss or damage to the Products only when the Client or a third party designated by him (and not the carrier) actually takes over such Products.

Conversely, if the Products are lost or damaged before material delivery to the Client or a third party designated by him, effe luxury vintage will reimburse the Client for the amount paid.


Product Conformity

7.1. Upon delivery, the Client must inspect the Products to ensure that they correspond to the items ordered and are free from manufacturing defects or non-conformity defects. The legal guarantees provided for by current legislation apply to the sale of the Products, as well as other conventional guarantees that may be offered to the Client.

7.2. In the event of a manufacturing defect or non-conformity, the customer is entitled to restore conformity of the product free of charge by repair or replacement, unless the requested remedy is objectively impossible or disproportionately onerous compared to other remedies. If one of the assumptions provided for by law occurs, the customer may demand an appropriate price reduction or terminate the contract and thereby refund the price paid. The customer loses this right if the customer does not report the non-conformity to effe luxury vintage within 2 (two) months from the date of discovery of the defect. In any case, effe luxury vintage is only liable for conformity defects that arise within 2 (two) years of delivery of the product. Actions for claiming defects expire within 26 (twenty-six) months of delivery of the product.

In order to report faults and defects in the product and obtain one of the aforementioned remedies, the customer may contact effe luxury vintage at the following e-mail address: customercare@effeluxuryvintage.com.


Returns and Refunds – Withdrawals

8.1 The customer has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery or collection of the product, with the exception of personalized products. For split orders, this period starts from the date of delivery or collection of the last product.
To exercise the right of return, the customer must send a refund request to customercare@effeluxuryvintage.com, including the order number, the item for which a refund is requested and the reason for the refund. Upon receipt of the request, effe luxury vintage will receive it and reserves the right to evaluate and accept the same return request. Return shipping costs are at the buyer’s expense. Refunds will be processed immediately after receipt, verification and acceptance of the returned item. The item must not have been worn, washed or altered or generally used. The effe luxury vintage label with the safety cord on the returned item must not have been cut, damaged or tampered with in any way. For orders paid by credit card, the refund amount will be returned to the customer within approximately 10 days and in any case will appear on the next credit card statement. Depending on the bank circuit of the credit card used, the refund time may vary slightly. For orders paid by Paypal or bank transfer, the amount will be refunded to the original account. The refund will be issued in the currency used for the original purchase. Any difference in amount caused by exchange rate fluctuations will not be refunded. Returns must be sent within 7 days of being authorized by effe luxury vintage and can only be sent via the email address: customercare@effeluxuryvintage.com. Returns must be sent in their original packaging. If the customer receives a defective item, or if effe luxury vintage makes an error in shipping, you will need to follow the same instructions as above. effe luxury vintage reserves the right to request photographic evidence before authorizing the return of defective items and to cover the shipping costs of returning the items to its premises. effe luxury vintage reserves the right to refuse unauthorized returns or returns that do not meet all of the stated conditions.
If the customer does not follow this procedure, effe luxury vintage reserves the right not to make a refund and the customer will still be responsible for the costs of returning the items and any liability for loss, theft, damage or delay in delivery.

The customer undertakes to return the products for which he has exercised his right of withdrawal without undue delay and in any event within 14 (fourteen) days from the date on which he notified effe luxury vintage of his decision to withdraw from the contract and the return was accepted.
Products must be returned in the same condition in which they were delivered. Therefore, the customer must ensure that the product is intact, has never been used, worn or damaged in any way, and that it is returned in its original packaging with all the labels attached as it was received. If the product is accompanied by a security label, no return of the product will be accepted if the original security label has been removed, damaged or tampered with. The customer also acknowledges that, for safety and hygiene reasons, perfumes cannot be returned if the sealing cellophane and the original packaging have been opened, damaged, altered or removed. effe luxury vintage will check the packaging and condition of each individual returned product, constituting the essential integrity of the basic requirement for exercising the right of return.
effe luxury vintage reserves the right to refuse the return of products that are damaged, spoiled, dirty or clearly show that they have been used for purposes other than the customer’s inspection, which is absolutely necessary to determine the nature and characteristics of the purchased product.
If a return is refused, effe luxury vintage will send a specific notification to the customer and will not proceed with the refund of the price paid by the customer, while reserving the right to claim compensation for any losses caused by the customer’s actions.
effe luxury vintage will refund the price of the returned product immediately and in any event within 14 (fourteen) days from the day on which effe luxury vintage becomes aware of the client’s exercise of the right of return. effe luxury vintage reserves the right to refuse a refund in any case until the product has been received and verified. Unless expressly agreed otherwise by the client and provided that the client does not incur any costs as a result of the refund, the aforementioned refund will be made by re-crediting the amount paid by the client, using the same payment method as used for the purchase. effe luxury vintage will confirm to the client by email that the price has been refunded.

Returns are permitted under these terms only for products purchased on the Website.
The client cannot exercise a right of return for custom-made products, taking into account that they are products permanently modified and customized for the client and cannot be restored in any way to their original production. Therefore, the provisions of this article 8 do not apply to personalized products, it being understood that the exclusion of personalized products from the right of return does not affect the applicability of the legal guarantees provided for in article 7 above to such products.
In the event of shipments to countries subject to customs duties, the costs are fully borne by the client, even if unforeseeable.
effe luxury vintage offers a flexible return policy to make your online shopping experience easier. However, we may refuse returns at our discretion.


Limitation of liability

9.1. Except in cases of wilful misconduct or gross negligence, effe luxury vintage will not be liable in any way for indirect or consequential damages arising from the purchase of products sold on the Website.


Product authenticity and intellectual property

10.1. effe luxury vintage guarantees the authenticity of all products sold on the Website.
